La o zi după clasarea dosarului Ordonanței 13, Parchetul General a clasat, marți și dosarul alegerilor din decembrie 2009, constatând că nu s-au produs infracțiuni de abuz în serviciu și nici de falsificare a documentelor și evidențelor electorale.
În acest fel, Comisia parlamentară de anchetă pe același subiect, înființată în luna aprilie în urma dezvăluirilor din presă ale jurnalistului Dan Andronic, este inutilă.
“Procurorii Secției de urmărire penală și criminalistică din cadrul Parchetului de pe lângă Înalta Curte de Casație și Justiție au dispus clasarea cauzei menționate anterior, întrucât — din coroborarea probelor administrate — s-a stabilit că nu s-a decelat niciun element/indiciu de natură să conducă la presupunerea rezonabilă că s-ar fi încercat/inițiat de către persoanele nominalizate, acte/acțiuni ce ar intersecta sfera ilicitului penal, respectiv ce ar contura textul incriminator al infracțiunii de abuz în serviciu, prev. de art.297 alin. 1 Cod penal cu aplic. art.5 Cod penal (art.248 rap. la art.2481 din vechiul Cod penal) și al infracțiunii de falsificarea documentelor și evidențelor electorale, prev. de art.391 alin.3 și 4 din Codul penal cu aplic. art.5 Cod penal (fost art.62 alin. 3 și 4 din Legea nr.370/2004 pentru alegerea Președintelui României)”, se arată într-un comunicat al Parchetului General.
La Parchet au fost audiați ca martori Traian Băsescu, Dan Andronic, Gabriel Oprea, Anghel Iordănescu și Neculai Onțanu.
În paralel cu ancheta procurorilor, Comisia parlamentară a audiat mai multe persoane, între care George Maior, fost șef al SRI.
