Official documents. The case prosecutor Mihaela Moraru-Iorga is investigating a case that may open the gate to the cross-border anticorruption fight locked by politicians.
On the 10th of December 2014, I published in PUTEREA (“THE POWER”) newspaper the first episode of the EADS FRAUD Scheme. 440 days have passed since that time, I reached episode 8 of my journalistic investigation, but I haven’t received any news from DNA, although the case prosecutor Mihaela Moraru-Iorga has investigated the EADS penal file since 2012. Today, I submit to your attention the CONTRACT signed between EADS and COMICEX, the company owned by MAI.
It is an official DOCUMENT. It is THE CONTRACT that produced huge financial and image damage to Romania and which hasn’t resolved until today – February 23, 2016, almost 12 years after signing the contract – the border securitization. Instead, through the EADS – COMICEX MAI Contract, a fraud of hundreds of millions of EUR was put into practice, and shady characters like Năstase, Rus, Nica, Săniuță, Blaga, Oprea, David etc. have illegally satiated from the public money.
Brief summary of the journalistic investigation
In the first episode and in the third one I have presented to you, in two schemes, the corrupted that conceived and implemented the EADS FRAUD – names, positions, companies!
In episode 2, I presented to the public the coercive methods used by the MAI generals Zaharia, Carp and Gagiu over the UMP members, so, at the end, to be signed a damaging contract for Romania, but favorable to EADS.
In episode 4, I showed you how much the German Chancellor Angela Merkel and the former French President, Nicolas Sarkozy, are involved in the EADS FRAUD Scheme.
In episode 5, I offered an information “forgotten” by all “good people” in Romania: that VneshtorgBank, the giant state bank from Russia, acquired for the Russian state 5.02% of the EADS shares, in the summer of 2005, in a moment when the airspace and European security conglomerate was falling, after the crisis caused by the delay of delivering Airbus A-380 airplanes. And the Russians of Putin didn’t miss the opportunity to penetrate a UE entity in an extremely important field, as the border securitization.
In episode 6, I published a few pages of the Feasibility Study developed by the German company BEARING POINT and the Romanian Cătălin Cedric Ghigea. From the DOCUMENTS presented, it can be noticed that even the wise-guys from BEARING POINT refused to state clearly how much should cost the Border Securitization made by EADS. Also, the “specialists” of BEARING POINT thought of a three years study, for a total amount of maximum 540 million EUR. But, being pressured by the Romanian part and by Ghigea, the Germans have “thrown” in a phrase also a possible maximum value of the contract of 800 million EUR.
In an intermediary episode (III), I published the information that Tom Enders, CEO AIRBUS, negotiated with the multinationals KKR and CARLYLE the sale of the border securitization division for 1.3 billion EUR. In his attempt of cleaning the giant AIRBUS of the divisions involved in fiscal frauds and cross-border corruption, Tom Enders wanted to sell what we symbolically call EADS. But, ironically, the sale of the “EADS Division” by AIRBUS is at the hand of Romania, which has the right to oppose to the transaction, because of the contract that generated the huge EADS fraud! At that time, I also wrote that, in these circumstances, the discussion held in Berlin between Merkel and Cioloş becomes extremely interesting. But from the notice of sale expressed by Enders, on the axis of the palaces Cotroceni and Victoria it is kept a mystery regarding the answer to an entitled question: How will the president Iohannis and the prime-minister Cioloş play this “ball of fire”?!?
Finally, in episode 7, I presented EXCLUSIVELY a NOTE based on the Romanian and UE legislation, document drawn by the MAI lawyers, which stood prominently on the desk of the Interior Minister, Vasile Blaga. Through this MAI NOTE, I proved that the ex-Minister Blaga lied when he said that nothing more could have been done in the case of the EADS FRAUD. In fact, the NOTE proves that Vasile Blaga knew and he remained silent! And he did NOT move in front, as a mercenary who was in the service of the “white collars” conspiracy, even since he had led the Customs!
The Contract of 650 million EUR
Today, in episode 8, I am offering you for reading the EADS-COMICEX Contract. You will encounter several unpleasant surprises: some articles had no place in this contract, IN THE WRITTEN FORM and signed by Simona PANAIT, at the order of the Interior Minister Marian SĂNIUȚĂ, who, in his turn, respected an order given by the prime-minister Adrian NĂSTASE. I offer you a few samples:
ART. 7 pt. 2 states that the First Detailed Appendix (PAD) will be signed after signing the contract. This provision is incredible. Why? Because only the PAD will specify the subject of the contract with the technical details and costs. And in this case, what has Simona Cristina Panait signed at the order of the convicted prime-minister Adrian Năstase? That WE are obliged to pay the crooks from EADS at least 650 million EUR!
ART. 8 pt. 7 states that the Contract Price, of 650 million EUR, is a minimum estimated price (…). “As regards the following phases of the Contract, corresponding to the Detailed Appendixes that would be completed between 2006-2009, the Contract Price is partially based on assumptions” – incredible, minimum price and based on assumptions, not on certainties!
ART. 8 pt. 9 states that an advance of 15% (fifteen percent) of the total amount of each Detailed Appendix will be paid by the BUYER to the SELLER, after the Credit Contract takes effect;
ART. 9 pt. 1 states that Romania will assure the financing of the System’s development and implementation, under the terms of a Credit Contract concluded in the basis of the Romanian Government Decision No. 1157 from 23 July 2004… And at pt. 4 it is very clearly specified that EADS will be responsible to find a group of banks to provide the credit of 650 million EUR. Please notice how much “solidarity” from the part of the EADS crooks!
ART. 9 pt. 5 states how payments are to be made in the period 2004-2009. Nothing about the project’s completion;
ART. 9 pt. 5 align. 10, in a cruel defiance of the public money, also mentions “Other fees and expenses – The financing offer will contain amounts/percentages, methods of calculation and of payment”;
ART. 11 provides the payment terms. Romania will always pay an advance of 15% for each service/work;
ART. 13 makes again reference to PAD, the appendix which was neither negotiated nor signed before signing the contract – a legal aberration, a totally illegal maneuver;
ART. 18 states that “All packages supplied by the SELLER would be considered nonreturnable, and their cost will be included in the Contract Price”. Do you understand, good people?!? In order to reach the astronomical cost of 650 million EUR, EADS forced us to pay SEPARATELY also the wrapping. How bastards were Năstase, Rus and Săniuță, to accept twice the payment of the packaging – the package being always included in the price by the producer?!?
ART. 21 states that the “SELLER agrees to conclude a framework agreement regarding the compensatory operations, in no more than sixty (60) days from the date of signing the Contract, in which he recognizes its obligation to perform compensatory operations. This article was broken by EADS. The OFF-SET Contract between EADS and OCATS was signed in … 2006, when big chief was Cristian Tarara, the buddy of iniquities of the liberal Vlad Moisescu.
And the examples may continue. I let the lawyers of the “clean” political parties that wish to start a crusade to recover the money defrauded by the leaders of the “old” parties to discover other illegalities provided by the EADS-COMICEX Contract.
